These Terms and Conditions apply to all equipment, services and crew supplied by Bounce Lighting Limited. By hiring equipment or services from Bounce Lighting Limited, the Client agrees to the following Terms and Conditions.
Definitions
Company refers to Bounce Lighting Limited.
Client refers to the individual, production company, organisation or representative hiring equipment
or services from Bounce Lighting Limited.
Equipment refers to any lighting fixtures, control systems, accessories, stands, cables, power distribution, transport equipment or related items supplied by Bounce Lighting Limited.
Hire Period refers to the period beginning when the equipment leaves the possession of Bounce Lighting Limited and ending when the equipment has been returned, inspected and accepted by Bounce Lighting Limited.
Services refers to any technical support, crew, lighting design, delivery, collection or related services provided by Bounce Lighting Limited.
General Terms
All hires are subject to these Terms and Conditions unless otherwise agreed in writing.
The Client confirms that they have the authority to enter into a hire agreement on behalf of their production or organisation.
Bounce Lighting Limited reserves the right to refuse hire where necessary.
Any quotation issued by Bounce Lighting Limited does not constitute a binding contract until confirmed by Bounce Lighting Limited.
Hire Period
The Hire Period begins when the equipment leaves the control or possession of Bounce Lighting Limited.
The Hire Period ends once the equipment has been returned, inspected and accepted by Bounce Lighting Limited.
Equipment returned late may incur additional hire charges.
If the Client fails to return equipment as agreed, Bounce Lighting Limited reserves the right to charge additional hire fees until the equipment is returned.
Responsibility for Equipment
The Client is fully responsible for all equipment during the Hire Period.
This responsibility includes loss, theft, damage, misuse or negligence.
The Client must ensure that all equipment is operated safely and by competent personnel.
The Client agrees to protect equipment from weather damage, improper storage, unsafe transportation or misuse.
Damage, Loss or Theft
The Client accepts full responsibility for any damage to equipment during the Hire Period.
If equipment is lost, stolen or damaged beyond repair, the Client agrees to pay the full replacement cost of the equipment on a new-for-old basis.
Bounce Lighting Limited reserves the sole right to determine whether equipment will be repaired or replaced.
The Client shall be responsible for all repair costs, replacement costs and associated expenses.
Loss of Hire
Where equipment is damaged, lost or stolen, the Client shall also be responsible for loss of hire charges.
Loss of hire will be calculated based on the standard rental rate of the affected equipment.
Loss of hire charges will apply for the period required to repair the equipment, replace the equipment or obtain a suitable replacement.
Loss of hire charges may continue until the equipment has been repaired or replaced and is available for hire again.
The Client remains responsible for loss of hire charges even where an insurance claim is made.
Insurance
The Client is responsible for ensuring that all hired equipment is fully insured during the Hire Period under the Client’s production insurance policy.
Insurance must cover loss, theft, accidental damage, transit and full replacement value.
Bounce Lighting Limited may request proof of insurance before equipment is released.
If the Client does not have suitable insurance cover, Bounce Lighting Limited may offer optional insurance cover for an additional fee.
Where optional insurance is provided by Bounce Lighting Limited, the cover will be subject to the terms of Bounce Lighting Limited’s insurance policy.
The Client will remain responsible for any applicable insurance excess.
Optional insurance does not remove the Client’s responsibility for loss of hire, negligence, misuse or breach of these Terms and Conditions.
Use of Equipment
Equipment must only be used for professional film, television or commercial production purposes.
Equipment must be operated according to manufacturer guidelines and by competent personnel.
Bounce Lighting Limited accepts no responsibility for injury or damage resulting from misuse of equipment.
Delivery and Collection
Delivery and collection services may be arranged where agreed.
Bounce Lighting Limited shall not be responsible for delays caused by traffic, weather, transport disruption or circumstances beyond reasonable control.
The Client is responsible for ensuring safe access for delivery and collection of equipment.
Payment Terms
Payment terms will be agreed prior to hire.
Bounce Lighting Limited reserves the right to require payment in advance.
Overdue invoices may incur interest and recovery costs.
Cancellation
Cancellation charges may apply depending on when notice of cancellation is received.
Bounce Lighting Limited reserves the right to charge for reserved equipment where cancellation occurs at short notice.
Liability
Bounce Lighting Limited shall not be liable for production delays, financial losses or indirect damages resulting from equipment failure or unforeseen circumstances.
The Client accepts full responsibility for the safe use of all equipment supplied.
Force Majeure
Bounce Lighting Limited shall not be held liable for failure or delay in performance caused by events beyond reasonable control including but not limited to weather, transport disruption, strikes, accidents or equipment failure outside the Company’s control.
Ownership of Equipment
All equipment supplied remains the sole property of Bounce Lighting Limited at all times.
The Client shall not sell, sub-hire, assign, pledge or otherwise deal with the equipment in any way inconsistent with the Company’s ownership.
Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
